Creditor Harassment

Professional Chapter 7 and Chapter 13 Litigators

What is Creditor Harassment?
Creditor harassment occurs when creditors or collection agencies engage in illegal collection practices like name calling, issuing false legal notices or calling debtors over and over.  When creditors engage in illegal practices, debtors have the right to report the creditors’ behavior and stop the harassment.

Creditor Harassment is Illegal
In the United States, creditor harassment is unlawful.  Years ago, the government passed the Fair Debt Collection Practices Act (FDCPA).  This Act specifically says that creditors must not engage in menacing behaviors when attempting to recover funds from debtors as it is illegal.

Examples of Creditor Harassment
Every day, countless people throughout the U.S. are subjected to creditor harassment.  Some examples of creditor harassment include, but are not limited to:

  • creditors calling daily
  • creditors calling debtors at their place of employment
  • creditors calling debtors names
  • creditors issuing verbal threats
  • creditors threatening to call a debtor’s family, friends, neighbor or employer
  • creditors calling at unreasonable hours
  • creditors issuing false legal documents to obtain payment
  • creditors telling debtors that they will be arrested if they do not pay their debts
